Day Pitney LLP announced that it has named partners Mark A. Romance and Ann Hetherwick “Hether” Cahill co-chairs of the firm’s Fiduciary and Probate Litigation practice group. In these leadership roles, Romance and Cahill will direct and oversee strategic initiatives and legal work for clients seeking legal advice on fiduciary, trust, and probate litigation-related matters across Day Pitney’s jurisdictions, including Connecticut, Florida, Massachusetts, New Jersey, New York, and Rhode Island.

Romance and Cahill will draw on the experience of approximately 35 attorneys from across all of the firm’s offices, all of whom have extensive experience in contested trust, estate, and guardianship matters. The team handles all fiduciary, trust, and probate litigation matters, including helping clients with cross-jurisdictional issues. The practice group perfectly complements the firm’s Private Client department, one of the country’s largest and most sophisticated. The group benefits from the technical estate planning, estate administration, and tax experience of our trusts and estates lawyers on matters, as well as our corporate and real estate departments, giving clients an advantage in contested matters due to the depth and breadth of our full-service firm along the east coast.
Romance is a seasoned trial and appellate attorney representing diverse clients in commercial and other complex litigation. He handles sophisticated estate and trust litigation in Florida, including advising beneficiaries in will and trust disputes; personal representatives, trustees, and curators in matters involving alleged breaches of fiduciary duty; protecting an estate during will and trust disputes; and disputes over admission of wills and nomination of competing putative personal representatives. Romance has extensive experience representing clients in cases involving multimillion-dollar claims in high-stakes litigation. Romance earned his B.A. from George Washington University and his J.D., high honors, from St. Thomas University School of Law. He is admitted to practice in Florida.

Cahill represents individual beneficiaries and individual and corporate fiduciaries in fiduciary, probate, and trust disputes. Her practice specializes in a wide range of probate, trust, equity, fiduciary, guardianship, and conservatorship litigation, including trust and will contests; breach of fiduciary duty and removal actions; trust interpretation, modification, and termination actions; contested accountings; declaratory judgment actions; complaints for instructions; conservatorships, including with expanded powers for estate planning; and guardianships. She also serves as trustee of private trusts and personal representative of estates. Cahill advises clients at every stage of litigation, sometimes avoiding litigation entirely or resolving issues through mediation. As a former Massachusetts Appeals Court law clerk, she brings her strong writing skills and knowledge of the appellate process to contested matters, trials, and appeals.

Cahill earned her B.A. from Skidmore College and her J.D. from Suffolk University Law School. She is admitted to practice in Massachusetts.
