
Gallagher is pleased to announce that Anatoly Smolkin has joined the firm as a Partner in its Litigation and Investigations practices. Mr. Smolkin returns to Gallagher after serving as an Assistant United States Attorney in the District of Maryland from 2018 to 2025.

During his tenure as a federal prosecutor, Mr. Smolkin handled all phases of criminal litigation, leading investigations into violations of federal laws, including those involving racketeering, firearms and narcotics offenses, money laundering, healthcare fraud, and public corruption. His impressive trial experience includes trying multiple cases to verdict—including a three-month, multi-defendant racketeering trial—and briefing and arguing appeals before the United States Court of Appeals for the Fourth Circuit.
Mr. Smolkin joins Gallagher’s Litigation and Investigations practices, where he counsels clients on sensitive internal and independent investigations and represents clients in response to government investigations and enforcement actions. An accomplished trial and appellate litigator, Mr. Smolkin also represents businesses and individuals in complex commercial disputes, real estate and construction litigation, and constitutional litigation.

Before his government service, Mr. Smolkin was a litigator at Gallagher where his practice focused on commercial and business litigation, construction disputes, bankruptcy litigation, and other financial disputes. He also maintained a significant pro bono practice, representing individuals in state and federal post-conviction proceedings and in civil rights litigation.
From 2015 to 2018, Mr. Smolkin served on the Discretionary Panel of the U.S. Court of Appeals for the Fourth Circuit, appointed to represent indigent parties on appeal in civil, civil rights, habeas corpus, and bankruptcy cases, among others.
Following law school, Mr. Smolkin served as a law clerk to the Honorable J. Frederick Motz of the United States District Court for the District of Maryland and the Honorable Stephanie D. Thacker of the United States Court of Appeals for the Fourth Circuit.
Mr. Smolkin received his Juris Doctor, summa cum laude, from the University of Maryland School of Law, where he was an associate editor of the Maryland Law Review and a member of the Moot Court Board. He earned his Bachelor of Science degree, summa cum laude, from Stevenson University.
Active in professional and community service, Mr. Smolkin currently serves as a Board Member of the Maryland Chapter of the Federal Bar Association and previously served on the Board of Court Appointed Special Advocates (CASA) of Baltimore City.
